How does the change affect the rights of third parties?

Your answer should include:

• who the third party is/are
• which clause or clauses are being changed
• what the current rights are and whether those rights are being changed or removed
• if the clause being amended would have required a third party’s consent to change it had you used a power of amendment in your governing document
• if the third party is aware of the change and, if so whether they have given their consent. If you have not contacted them, or they did not give consent, explain why.
• if the third party has died (where the third party is an individual) or no longer exists
• If the third party is a living person (rather than an organisation) contact details for the third party (ideally an email address)
